Terms of Service

1. Membership & Accounts

• Memberships are personal and non-transferable unless otherwise stated.
• You must provide accurate, current, and complete information during registration.
• You are responsible for keeping your account and login details (if applicable) secure.
• We reserve the right to deny, suspend, or terminate memberships or services for violations of these Terms or inappropriate conduct.

2. Facility Use

• Members and guests must follow all posted rules, staff instructions, and safety guidelines.
• Proper attire and footwear are required at all times.
• Equipment must be used only for its intended purpose and returned after use.
• Locker rooms, restrooms, and other amenities must be used respectfully and kept clean.
• Unauthorized photography or video recording in private areas is prohibited.

3. Health & Safety

• You represent that you are physically able to participate in fitness activities and assume full responsibility for your health and safety while using our facilities.
• You must immediately notify staff of any accidents, injuries, or unsafe conditions.
• Genesis Fitness Center is not responsible for any pre-existing medical conditions or injuries sustained during participation.
• We reserve the right to deny facility access to any member showing illness, unsafe behavior, or disregard for others.

4. Payments & Billing

• Membership fees, class fees, and other charges are due according to the plan you select.
• Payments are non-refundable except where required by law or specified in writing.
• Late or declined payments may result in suspension or cancellation of membership.
• Taxes and fees may apply and will be disclosed at the time of purchase.

5. Cancellations & Refunds

• Membership cancellations must comply with your membership agreement.
• We may allow cancellations or freezes for medical or relocation reasons with proper documentation.
• Prepaid services (such as classes or training sessions) may expire if unused by their stated expiration date.

6. Personal Belongings

• We are not responsible for lost, stolen, or damaged personal property.
• Lockers may be provided for convenience but are not secure storage.
• Items left unattended may be removed by staff.

7. Conduct

• Harassment, abuse, discrimination, or disruptive behavior toward staff or other members will not be tolerated.
• Illegal activities on premises are strictly prohibited.
• Violations may result in immediate termination of membership without refund.

8. Liability Waiver

• By using our facilities, you acknowledge that participation in fitness activities carries inherent risks, including injury or illness.
• You voluntarily assume all risks and release Genesis Fitness Center, its staff, and affiliates from liability for injuries, accidents, or damages, except where prohibited by law.

9. Changes to Services

• We may add, remove, or modify equipment, classes, hours, or amenities at any time.
• Temporary closures (for maintenance, holidays, weather, etc.) do not entitle members to refunds unless otherwise stated.

10. Intellectual Property

• All logos, branding, website content, and materials are property of Genesis Fitness Center.
• You may not copy, distribute, or misuse our content without written permission.

11. Termination

• We reserve the right to suspend or terminate your membership or access for violations of these Terms.
• Upon termination, your right to use our services immediately ceases.

12. Governing Law

These Terms are governed by the laws of the State of Arkansas. Any disputes will be handled in the courts of Independence County, AR, unless otherwise required by law.
